Plaintiffs' lawyers say bellwether process benefits corporations.

Plaintiffs' lawyers say that the shift in how bellwether cases are now selected is an impediment to their cases, and that it actually works to the advantage of defendants. In addition, the timeframe for bellwether cases can last for years, another factor which is advantageous to defendants since they can afford to drag out the process indefinitely. Reuters noted that in January, an Illinois court will hear a case against Bayer AG which alleges its birth control pill, Yaz/Yasmin (drospirenone/ethinyl estradiol), was responsible for heart attacks and other illnesses.

Judge: New method helps reduce costs in medical liability cases.

McKeon was bothered by how medical liability cases were being treated in the system." These "claims were classified the same as every other civil lawsuit, despite medical liability issues being more complex and taking more time to review, said McKeon, an administrative judge in the Supreme Court of Bronx County." Therefore, almost a decade ago, he "began a unique approach to evaluating liability claims in collaboration with New York City Health and Hospitals Corp., the largest municipal health care organization in the US. The strategy, called judge-directed negotiation, focuses on early court intervention and facilitating discussion among attorneys about claims and potential settlements." According to McKeon, this idea "cuts legal costs and resolves cases years earlier than a traditional court route."

Oklahoma House bill would cap damages for medical malpractice.

Lost wages and medical expenses are not capped." The measure "has exceptions for cases of gross negligence, reckless disregard, intentional actions or malicious conduct." Advocates of the bill "say it will make Oklahoma more business friendly, while critics say it harms the most vulnerable in the state, such as women, the elderly and children who may have no or limited income." One Tulsa attorney said that the measure may violate the Oklahoma Constitution.

SEC urges defense lawyers to guard against conflicts of interest.

Justice Clarence Thomas issued a 19-page dissent, saying the court had rejected 'an opportunity to provide clarity to an establishment-clause jurisprudence in shambles.'" The piece agreed with Thomas' stance, saying that the "two appeals the court declined to hear on Monday -- Davenport v. American Atheists, No. 10-1297, and Utah Highway Patrol Association v. American Atheists, No. 10-1276 -- would have given the court an opportunity to clarify the murky guidance it has provided in this area."

Montana high court upholds denial of coverage for man dragged by truck.

Terry Richerson's widow had asked the state's high court to overturn a lower court's ruling that The Cincinnati Insurance Company did not have to pay for Richerson's medical and funeral bills from the accident at a construction site on the Benefis Healthcare campus in Great Falls." The court issued a unanimous decision Friday, saying "that to 'occupy' the truck, Richerson had to have a broader connection other than being struck by it."

On Monday, the justices "turned down an appeal from Avery Doninger, who was a high school junior in Burlington, Conn., when she took to the Internet to criticize administrators for canceling a popular school activity." The student "sued school officials after they punished her by preventing her from serving as class secretary as a senior."

Woman sues Wyeth for $10M Over hormone replacement drug.

The women accuse the companies of "manufacturing hormone therapy drugs that dramatically increase the risk of breast cancer, ovarian cancer, strokes, blood clots and cardiovascular disease." The hormone drugs "at issue are conjugated estrogens and medroxyprogesterone [Prempro], conjugated estrogens [Premarin], and medroxyprogesterone [Provera]." Cain was diagnosed with breast cancer after taking medroxyprogesterone for eight years.

Teamsters local agrees to settle work-rule lawsuit.

The monies "will be paid by the Metropolitan Pier and Exposition Authority, the city-state agency that owns the convention hall. The authority will pay the Teamsters with funds provided by Freeman and GES, the main private contractors that hire labor to set up and tear down shows." In addition, the authority "will cover up to $200,000 in Teamster legal fees, according to a memo on the settlement."

OSHA aims to fine Florida manufacturer for safety violations.

These "violations include lack of safeguards on machinery, excessively loud noises, and exposing workers to lead and other dangerous substances that could cause death or serious injury, OSHA said in a press release." But, the president of Sen-Dure "said the findings by the federal Occupational Safety and Health Administration are exaggerated and the agency is being 'unreasonable.'"

New York City settles Medicaid lawsuit.

TennCare to stop paying for preventable errors.

As of "July, TennCare plans to stop paying for conditions related to a foreign object being left in the patient's body after surgery; for the wrong surgery or invasive procedures being done; for the wrong body part being operated on; or for cases of mistaken identity that lead to other errors in treatment." Various physicians' groups have said that such errors should be considered a normal part of practicing medicine. However, Randy Kinnard, "past president of the Tennessee Association for Justice, an association of trial attorneys," argued, "Carelessness occurs and causes not only damage to the patient concerned and their family, but to the whole health-care system."

"Investigative attorney" questions devices meant to keep medications secure.

Marc Weber Tobias, "an investigative attorney and physical security specialist," wrote in a Forbes http://mailview.custombriefings.com/mailview.aspx?m=2011110101aaj&r=3914968-dbb2&l=01a-dac&t=c> (10/31) piece about two "devices, the RX Locker, and the RX Drug Safe," which are supposed to prevent children and teenagers from accessing "prescription medicines and narcotics in the home." Tobias questioned the efficacy of the devices, saying that "this technology...is pure 'security theater.'" He added, "More disturbing, companies have enlisted the endorsements of popular TV medical personalities to enhance the credibility of their products."

CPSC says about 20,000 injuries a year related to "instability" of TVs.

In addition, the report noted "that in 2010, emergency rooms across the country reported an estimated 20,000 injuries related to the 'instability' of televisions." CPSC spokesman Scott Wolfson said, "We view it as one of the most dangerous hidden hazards in the home."

FTC takes action against two apps claiming to be able to clear acne.

Almost "15,000 people paid for the app. Three people who marketed the apps settled an FTC lawsuit by agreeing to no longer market the products."

BMW recalling some vehicles due to possible fire hazard.

The vehicles affected, "all from the 2008-11 model years, are the 5 Series, 5 Series Gran Turismo, 7 Series, X5 and X6 equipped with turbocharged 8- or 12-cylinder engines, according to a Oct. 20 letter, which was posted on the agency's Web site over the weekend." The company "said the problem related to an auxiliary water pump that helped to cool the turbocharger. An electronic circuit board could fail and, 'in an extreme case,' lead to the 'smoldering of the water pump.'" North Carolina officials confirm nine E. coli cases.

Fifteen cases are still "under investigation." According to officials, "the revision comes as a result of new criteria applied to the outbreak, including lab evidence showing the same genetic fingerprint, whether patients have had symptoms since October 13 and whether patients attended the fair during the incubation period." It is still "unclear what at the fair may have caused the illness."

The case has not been settled."

Three more deaths reported to FDA in alcohol wipes case.

FDA documents sent in response to a Freedom of Information request by the paper indicate that a total of 11 deaths may have been due to contaminated wipes, although a supplier was not identified in five cases. In the report, FDA investigators say they "were unable to establish a clear connection between Triad's wipes and illness or death, but it could not rule it out in part due to missing data."

White House correspondent Ed Henry added, "President Obama still can't convince Congress to pass his jobs bill, so he brought a pharmacy manager and a cancer patient to the Oval Office to explain his move to deal with drug shortages that are putting lives at risk."

ABC World News (10/31, story 4, 0:30, Sawyer) reported that "for almost a year, we at 'World News' have been reporting on the growing drug shortages in this country. Chemotherapy drugs, antibiotics, heart medications, even those crash cart drugs used in emergencies. Well, today President Obama took action, signing an executive order, no Congressional approval necessary, to force drug companies to take action when there's a shortage on the horizon. The most immediate change, a crackdown on price gouging due to the shortages, and that will kick in, starting tomorrow." Report: Medicare inspectors must better track hospitals' mistakes.

Rep. Boustany "asked the I.R.S. to explain its plans for monitoring the so-called community benefits that nonprofit hospitals provided," as well as "how it would comply with requirements for filing annual reports to Congress on the charity care provided by all hospitals."

General Electric Propane Rangetops Recalled

The Consumer Product Safety Commission and Health Canada have announced a recall 470 GE Monogram Pro Rangetops with Grills. The propane burners may fail to ignite if the gas control knob is left in a position between OFF and LITE, "posing a risk of delayed ignition or explosion." The Consumer Product Safety Commission has announced a recall of 375,000 various Glider recliners with ottomans sold at Big Lots stores. The agency said exposed spaces between moving parts of the chair can create areas for toddlers and babies to become trapped. Judge: Suit Against JPMorgan to Go Forward

A U.S. District Judge has declined to dismiss a lawsuit against JPMorgan Chase & Co. that accused the company of "reducing or suspending home-equity lines of credit without a permissible reason." The judge, however, did dismiss fraud and "unjust enrichment" claims against the bank. Viking Range Corp. to Pay Fine for Not Reporting Product Defect

The Viking Range Corporation has agreed to pay $450,000 in civil penalties for failing to report defects in one of its refrigerator lines that led to consumer injuries. The company recalled the products in June 2009, but an investigation discovered that injuries had been reported to Viking several years before the recall was issued. Federal law requires manufacturers, distributors and retailers to report information supporting potential injury risks within 24 hours. Staff Report, PR Newswire 07/06/2011

Glass Candle Holders Recalled by Dollar Tree

The Consumer Product Safety Commission has announced a recall of 117,000 candle holders sold at Dollar Tree stores across the country. The agency said the glass holders have a tendency to shatter while in use, posing a laceration hazard to consumers. There have been no injuries reported associated with the recalled products. GM Hit with Class-Action Suit over Impala Defect

A class-action lawsuit was filed last week against General Motors that claims the company failed to fix a defect in hundreds of thousands of Chevy Impalas sold in 2007 and 2008. The lawsuit claims a defect in the vehicles causes the rear tires to become misaligned and easily worn down. GM fixed the defect in all Impalas used for police work, but failed to address the problem in the more-than 423,000 cars owned by civilians. Fred Meier, USA Today 07/06/2011
